Chapter 11: Telecommunications and Marketing

TSR required disclosures. CIPP/US telemarketing guide

The Telemarketing Sales Rule requires material information to be disclosed truthfully and promptly. The required content depends on the type of telemarketing offer.

Practical example

For a prize promotion, identify the seller, purpose of the call, goods or services and the promotion conditions before testing the required disclosures.

Common mistake

Remembering a call-script fragment without checking whether the facts involve a general sale, prize promotion, credit or another specific TSR rule.

The current Telemarketing Sales Rule contains the disclosure, conduct and recordkeeping requirements that apply to covered telemarketing transactions. Read the relevant subsection with the offer facts in view.

For CIPP/US study, identify the offer and caller conduct first. Then distinguish the required disclosure from a separate prohibition, payment rule or enforcement issue.

How this supports CIPP/US study

Use this lesson to identify the disclosure, workplace or cross-border rule that changes the result in a fact pattern. Continue with the CIPP/US study plan.
